With the implementation of the Mental Capacity Act, there is now a requirement for Deputies, Attorneys and others working with private clients to demonstrate that they are upholding the best interests of their clients in conducting their affairs. A group of experienced Visitors has formed an alliance to support Deputies, Attorneys and others in this by carrying out visits to clients on their behalf. The Independent Visitors, currently located in all areas of England and Wales, are able to pool their extensive knowledge and resources to provide expertise in working with elderly and disabled people. They have a comprehensive knowledge of Court of Protection and OPG procedures and of the health and social welfare context of clients. They are qualified to provide Skills Based Certificates for Lasting Powers of Attorney and are available to serve Notices, assist with NHS Continuing Healthcare Funding Applications etc.

Solicitors for the Elderly (SFE) is a national organisation of lawyers, such as solicitors, barristers, and legal executives who are committed to providing and promoting robust, comprehensive and independent legal advice for older people, their family and carers. SFE members have the knowledge that allows them to ignore the myths relating to ageing and the competence of elderly people. At the same time they will take into account and empathise with any difficulties, both mental and physical, which may accompany the ageing process. They are able to determine more easily between mental and physical disabilities and are more aware of social and health problems that arise as people age. This wealth of experience will hopefully put you at ease when resolving your legal issues. Not just any lawyer can be a member of SFE. Our members must have spent a substantial amount of their time working for elderly clients and have to fulfil our own criteria for membership. They must also follow our own code of practice. SFE members have experience and specialise in a wide range of legal issues affecting elderly people.
